The Law on Consumer Protection prescribed for the first time out-of-court protection of consumer rights in Montenegro.<\/p>\n
Recognizing the importance of consumer protection, the Chamber of Commerce of Montenegro, in accordance with the Law on Consumer Protection, has provided administrative and technical conditions for the work of the Committee, in which representatives of business entities and consumers participate equally as members. The Committee represents a form of alternative, efficient, and inexpensive resolution of consumer disputes. Only the consumer can initiate proceedings before the Committee. The parties in the proceedings before the Committee for out-of-court resolution of consumer disputes are the consumer and the trader. The consumer is a natural person who concludes a legal transaction or acts on the market outside their trade, business, craft, or professional activity. The trader is a person who independently or through another person acting on their behalf or for their account concludes a legal transaction or operates on the market within their trade, business, craft, or professional activity.<\/p>\n
The Committee has ten members from which a president and a deputy president are elected. Members of the Committee are elected by the Chamber and consumer organizations in equal proportion based on a public call. The list of Committee members is published by the Chamber in the “Official Gazette of Montenegro” and on its website. The president of the Committee is appointed by the head of the Ministry from among the Committee members upon their proposal, and the deputy president is appointed by the Committee president from among the Committee members.<\/p>\n
Members of the Committee are obliged to conduct proceedings independently and impartially and must not act as representatives of parties in the proceedings or the organizations that proposed them for membership in the Committee, nor receive or request instructions from them concerning the subject of the dispute. Committee members are obliged to keep confidential all data obtained during their work in the Committee and after the proceedings are concluded, in accordance with the law.<\/p>\n
By constituting the Committee for out-of-court resolution of consumer disputes, greater importance is given to the out-of-court resolution of these disputes as a faster, more economical, and more efficient way of resolving consumer disputes compared to other methods of dispute resolution.<\/p>\n","protected":false},"excerpt":{"rendered":"
